TERMS AND CONDITIONS

§ 1. General Provisions

1. These Terms and Conditions set out the organization, rules, and conditions for the operation of the online store available at www.qualash.com (the “Online Store”).

2. The Online Store is operated, and all sales contracts concluded via the Online Store are entered into, by:

hereinafter referred to as the “Seller” or the “Service Provider”.

3. Quacosmetics Sp. z o.o. is the sole seller and service provider for all orders placed via the Online Store, regardless of the Buyer’s location or delivery destination.

4. For the purposes of cross-border sales, the Seller holds the following additional registrations:

United Kingdom – VAT number: GB504861302
EORI number: GB504861302000

These are tax and customs registrations of Quacosmetics Sp. z o.o. and do not create a separate contracting party.

5. These Terms and Conditions define in particular:
a) rules for using the Online Store,
b) rules for concluding and terminating electronic service agreements,
c) rules for concluding sales contracts, payments, and deliveries,
d) rights and obligations of Users and Buyers,
e) rights, obligations, and liability of the Seller,
f) out-of-court complaint and dispute resolution procedures.

§ 2. Definitions

For the purposes of these Terms and Conditions, the following terms shall have the meanings set out below:

a) Terms and Conditions – this document, available at all times at qualash.com,
b) Online Store – the website available at www.qualash.com,
c) User Account – an electronic service enabling access to order history and user data,
d) Registration Form – an electronic form enabling account creation,
e) Service Provider / Seller – Quacosmetics Sp. z o.o., ul. Domaniewska 37/2.43, 02-672 Warsaw, Poland, KRS 0001136660, NIP PL5214093556,
f) User – any person using electronic services of the Online Store,
g) Buyer – a User concluding a sales contract via the Online Store,
h) Consumer – a Buyer acting outside their business or professional activity,
i) Entrepreneur – a Buyer acting within their business or professional activity,
j) Goods – movable items offered for sale via the Online Store,
k) Order – a declaration of intent to purchase Goods,
l) Price – the gross price including applicable taxes,
m) Sales Contract – a contract concluded between the Buyer and the Seller via the Online Store,
n) Newsletter – an electronic service providing commercial information by email.

§ 2a. Fulfillment and Logistics

1. The Seller uses external warehousing and fulfillment providers in order to ensure fast delivery on individual markets.

2. Orders may in particular be dispatched from, and returns may be received at, the following warehouses of the Seller:

Poland: ul. Dąbrowskiego 44, 59-930 Pieńsk, Poland
Germany: Johannes-R-Becher-Strasse 29, 02827 Görlitz, Germany

Orders may also be fulfilled through third-party fulfillment networks operating in the country of delivery, including Amazon Multi-Channel Fulfillment (MCF).

3. The use of an external warehouse or fulfillment provider does not affect the identity of the Seller. Quacosmetics Sp. z o.o. remains the party to the Sales Contract, issues the invoice, and bears full responsibility for the performance of the contract.

§ 3. Use of the Online Store

1. Use of the Online Store requires acceptance of these Terms and Conditions.

2. Technical requirements:

compatible web browser,
active email account.

§ 4. Electronic Services

1. The Online Store provides:
a) User Account,
b) Newsletter (upon consent).

2. Electronic services are provided free of charge.

3. Users may terminate electronic services at any time by email: contact@qualash.com.

4. Complaints regarding electronic services shall be processed within 14 days.

5. The Service Provider may suspend or terminate services in case of violations of these Terms and Conditions or applicable law.

§ 5. Sales Contracts

1. Orders may be placed 24/7 via the Online Store.

2. A Sales Contract is concluded between the Buyer and Quacosmetics Sp. z o.o. when the Buyer confirms the order with the obligation to pay.

3. Acceptance of the order is confirmed by email.

4. Product images are illustrative and may differ slightly from actual appearance.

§ 6. Payments and Delivery

1. Payments may be made via the payment methods made available at checkout, in particular Przelewy24 (P24), BLIK, payment cards, Apple Pay, Google Pay, PayPal, Shop Pay and Klarna.

2. All payments are settled to the account of Quacosmetics Sp. z o.o.

3. Payment must be made within 2 days from order placement.

4. Delivery is carried out by courier companies.

5. Delivery time is indicated in the product description.

6. Free delivery thresholds and costs are presented during checkout.

§ 7. Complaints and Warranty

1. The Seller is obliged to deliver Goods free from defects.

2. Complaints may be submitted:

3. Complaints shall be reviewed within 14 days.

4. Statutory warranty rights remain unaffected.

§ 8. Non-Conformity of Goods

Consumer rights regarding non-conformity of Goods with the contract are governed by applicable consumer protection laws and remain fully applicable.

§ 9. Right of Withdrawal

1. Consumers have the right to withdraw from the contract within 14 days without giving any reason.

2. Detailed withdrawal instructions are included in Appendix No. 1.

3. Hygiene-sealed products opened after delivery may not be eligible for withdrawal.

§ 10. Out-of-Court Dispute Resolution

Consumers may use ADR or ODR mechanisms in accordance with applicable consumer protection regulations.

§ 11. Personal Data

Personal data is processed by Quacosmetics Sp. z o.o. as the data controller, in accordance with the Privacy Policy available at www.qualash.com.

§ 12. Reviews

1. Buyers may submit reviews of purchased Goods.

2. Reviews are verified and may be moderated.

3. Both positive and negative verified reviews are displayed.

§ 13. Final Provisions

1. These Terms and Conditions are governed by Polish law. Mandatory consumer protection provisions applicable in the country of the Consumer’s habitual residence remain unaffected.

2. The Seller reserves the right to amend these Terms and Conditions with at least 14 days’ notice.

3. These Terms and Conditions enter into force on 29 July 2026.

(Complete and return this form only if you wish to withdraw from the contract. Annex I(B) to Directive 2011/83/EU.)
